Terms and Conditions for “Teach Your Toddler to Swim” Online Course and Website.

 

Please read these Terms and Conditions ("Terms", "Terms and Conditions") carefully before enrolling in the “Teach Your Toddler to Swim” Online Course ("Course") operated by Kids in the Water LLC ("us", "we", or "our"). Your access to and participation in the Course is conditioned upon your acceptance of and compliance with these Terms.

 

By enrolling in the Course, you agree to be bound by these Terms. If you disagree with any part of the Terms, then you may not enroll in the Course.

 

1. Eligibility

To participate in the Course, you must be a proficient and safe swimmer. A proficient and safe swimmer is defined as someone who:

 

   a. Can swim at least 200 meters continuously in a pool without assistance.

   b. Is comfortable swimming in both shallow and deep water.

   c. Can tread water for at least 2 minutes without assistance.

   d. Can demonstrate the ability to perform at least two different swim strokes (e.g., freestyle, breaststroke, backstroke, or butterfly).

 

A participant must also demonstrate the ability to recognize the signs of drowning, which include silent struggle, head tilted back, mouth open and gasping, and arms flailing or pushing down on the water.

 

A participant must possess the skills to effectively assist and/or rescue a drowning person, including the ability to approach safely, provide flotation support, and utilize appropriate rescue techniques to bring the individual to safety.

 

By enrolling in the Course, you confirm that you meet these swimming proficiency and safety requirements.

 

2. Course Content

The Course is designed to teach parents how to teach their children to swim. The Course will provide instructional videos and written materials to facilitate learning. We reserve the right to modify or discontinue any part of the Course content without prior notice.

 

3. Intellectual Property

All materials provided in the Course, including but not limited to text, graphics, logos, images, and videos, are the property of Kids in the Water LLC or its content suppliers and are protected by copyright, trademark, and other applicable laws. You may not reproduce, distribute, or create derivative works from the Course materials without our express written permission.

 

4. Disclaimer of Warranties

The Course is provided on an "as-is" and "as available" basis. We make no representations or warranties of any kind, express or implied, as to the operation or availability of the Course or the information, content, or materials included therein. To the fullest extent permissible by law, we disclaim all warranties, express or implied, including but not limited to implied warranties of merchantability and fitness for a particular purpose.

 

5. Limitation of Liability

In no event shall Kids in the Water LLC, its directors, employees, or affiliates be liable for any direct, indirect, incidental, special, or consequential damages arising from your use or inability to use the Course or any content provided therein. This limitation applies to the fullest extent permitted by law.

 

6. Indemnification

You agree to indemnify, defend, and hold harmless Kids in the Water LLC and its affiliates, directors, officers, and employees from and against any and all claims, liabilities, damages, losses, or expenses, including reasonable attorneys' fees and costs, arising out of or in any way connected with your access to or use of the Course.

 

7. Governing Law

These Terms shall be governed and construed in accordance with the laws of Arizona, without regard to its conflict of law provisions.

 

8. Changes to These Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. By continuing to access or participate in the Course after any revisions become effective, you agree to be bound by the revised Terms. If you do not agree to the new Terms, you may not continue to participate in the Course.
